How do I push back on a clause?
- Open the review, then Risk register on its step rail. Read the row for the clause you want changed.
- Suggested pushback is ready to send as it is.
- Copy pushback puts it on your clipboard, for your reply to the builder or your own email.
- Email response, under What to do next, drafts one reply that covers every risk you have not marked I'm OK with this. You send it from your own email.
- If Proposed wording is under it, that is the clause as you want it to read. So you offer a fix, not a complaint. Copy wording copies it.
- Record what came back on the row, under What happened when you pushed back?. Pick Accepted, Compromised, Rejected or Not raised, and add a note if you want.
- How your pushback has landed, above the register, counts those across your reviews.
- The next review of a contract from the same builder opens with You have reviewed this builder before. It shows the score against last time, what often comes up with them, and the risks you accepted on their earlier contracts.
Worth knowing
This is a first pass, and it is not legal advice. If a clause could cost you the job, send your solicitor the brief the review exports. Do not send our words as your final position.
