How do I give notice of a delay?
What it does today
YourCA does not record yet that you gave the notice. So the date stays on the row and on the calendar after you send it. If YourCA could not read a delay notice period from your contract, the panel asks you the question and shows no date. A guessed deadline looks exactly like a real one.
- Open Delays on the Site tab. It lists every delay on the job. At the top, it shows how many notices already lapsed and how many you still have to give.
- Filter, on the band beside Record a delay, narrows the list. Pick Lapsed, Still to give or No deadline. Or pick the delays with no answer on their cause, or the delays still running.
- If the delay is not there yet, press Record a delay. It opens beside the list.
- It asks which day the delay happened, because the clock runs from that day. It does not run from the day you work out who to blame. The delay also goes on that day of the diary.
- Each row shows its day, what stopped you, the time lost and when notice is due. The clause shows beside the date.
- If your contract says business days, the count uses your state's business days.
- Press a row. It opens beside the list, and the list stays on screen so you keep your place.
- The notice, the clause and Draft the notice are at the top of that panel.
- Press Draft the notice and pick a PDF or a Word document. You get it on your letterhead. The day, what happened and what it stopped are already filled in from your record. Word is the one to fill in the remaining brackets.
- Export the register, on the band beside the Filter, gives every delay on the job as a PDF, a Word document or an Excel workbook, oldest first.
- It shows the day, what happened, the hours lost, what it stopped, whose act it was, the day notice falls due and the clause that sets it. It is the list to attach to an extension of time claim. It covers every delay, whatever the Filter shows.
- It does not say whether a notice was given, because YourCA does not record that yet.
- If the builder emailed you about it, use Draft the delay notice in the correspondence queue as the shortcut. It writes the delay onto the day the email is about. The receipt opens directly to that card.
- That shortcut writes the delay, not the notice. The notice needs the deadline from your contract, and there is nothing to draft until the delay exists.
- The document is only the notice: your letterhead, the clause, the day, what happened and what it stopped.
- Some things stay on the screen and not on the notice: what the clause costs you if you miss it, how the days are counted, and how your contract says to serve notices. These are your own working notes, and the builder does not need to read them.
- No contract reviewed on this job yet? You still get the notice, with the clause left as a bracket.
- The clock runs from the day the delay happened, not the day YourCA reads your contract. So YourCA never holds back the document because a review is missing.
- Fill in the brackets that are left.
- Sign the notice.
- Send it yourself, the way your contract says to serve notices. YourCA never sends anything to your builder.
- The same date shows on your Calendar as a Delay notice square. It also shows on the Dash brief while it is within six weeks.
- Change it and Remove it are in the same panel. While nobody has said whose act it was, Change it shows as Answer who caused it.
- A delay keeps the day it was recorded on. If a delay was on a day when the day closed, it freezes with the day. You can then only answer whose act it was.
- A closed day still takes a new delay, marked Added after the day closed. You can still correct or remove that one.
Worth knowing
Whether a delay gives you more time is a question about your subcontract, and a legal one. YourCA works out the day the notice is due and drafts the document. It does not decide the entitlement. It never fills in whose act the delay was.
